These Employer Terms of Service (the "Employer Terms") govern your access to and use of the Truckers Market platform as an employer, operator, or recruiter ("Employer"). By registering as an Employer on Truckers Market, you agree to be bound by these Employer Terms, our Privacy Policy, and our Website Terms & Conditions.

1. About Truckers Market

Truckers Market Ltd ("Truckers Market", "we", "us", "our") operates a digital marketplace that connects professional HGV drivers with employers, operators, and logistics businesses. Truckers Market is not an employment agency for the purposes of employing staff and does not employ drivers. We provide a technology platform that facilitates introductions, availability matching, and engagement between independent drivers and Employers.

2. Employer Status and Responsibilities

Truckers Market operates as an employment agency within the meaning of the Employment Agencies Act 1973. It does not operate as an employment business for the purposes of the Conduct of Employment Agencies and Employment Businesses Regulations 2003 and does not employ drivers, unless explicitly stated in writing under a separate agreement.

Drivers engaged via the Platform remain independent contractors and are not employees of Truckers Market.

4. Eligibility and Registration

We reserve the right to verify business details and to suspend or remove accounts that fail to meet these requirements.

5. Use of the Platform

Employers may use the Platform to search and view driver profiles, post engagement opportunities, make offers, and communicate with drivers via the Platform.

Any engagement between an Employer and a driver is a direct arrangement between those parties.

Truckers Market does not guarantee driver availability or performance, is not responsible for on-site supervision or working conditions, and does not act as an agent for either party. Employers are responsible for ensuring drivers are appropriately inducted, briefed, and supervised.

7. Fees, Payments, and Platform Model

7.1 Marketplace Model

Employers pay an engagement fee agreed via the Platform. After deduction of platform costs, the remaining net margin is split:
50% allocated to the driver and 50% retained by Truckers Market.

9. Compliance, Insurance, and Liability

Employers are responsible for providing a safe working environment, complying with health & safety, transport, and working-time laws, and holding appropriate business and site insurance.

Truckers Market is not liable for workplace incidents or conditions, employer compliance failures, or losses arising from driver engagement, except where required by law.

10. Ratings, Feedback, and Conduct

Feedback must be fair, factual, and non-discriminatory. Abuse of the feedback system may result in account action. Drivers may also provide feedback on Employers to promote trust and quality.

11. Data Protection and Confidentiality

Employers must use driver personal data only for engagement-related purposes, comply with applicable data-protection laws, and keep driver information secure and confidential. Personal data is processed in accordance with our Privacy Policy.

12. Account Suspension and Termination

We may suspend or terminate Employer accounts if these Employer Terms are breached, fees remain unpaid, Platform misuse occurs, or conduct risks harm to drivers or the Platform. You may close your account at any time, subject to settlement of outstanding fees.

13. Platform Availability

We aim to keep the Platform available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time.

14. Limitation of Liability

To the fullest extent permitted by law, Truckers Market excludes liability for indirect or consequential losses. Our total liability is limited to fees paid by the Employer in the preceding 12 months. Nothing in these Employer Terms limits liability where it cannot be excluded by law.

We may update these Employer Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated terms.

16. Governing Law and Jurisdiction

These Employer Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
